Ownership of Site; Agreement to Terms of Use

These terms and conditions of use (the “Terms of Use”) apply to all Life! websites, including those found at www.m250.org and other Life! websites, as well as all linked sites, its subsidiaries, and affiliates (collectively, the “Site”). Life! (“Life!”) and its licensors own the website. if you do not agree, do not use the site. by using the site, you agree to these terms of use. Life! maintains the right to alter, amend, add, or take away any part of these Terms of Use at any moment. It is your obligation to regularly check these Terms of Use for updates. You will be deemed to have accepted and agreed to the changes if you continue to use the Site after they have been posted. Life! now grants you a personal, non-exclusive, non-transferable, limited right to access and use the Site so long as you abide by these Terms of Use.

The design, structure, selection, coordination, expression, “look and feel,” and arrangement of all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, “Content”) on the Site are owned, controlled, or licensed by or to Life! and are protected by trade dress, copyright, patent and trademark laws, and other intellectual property rights. Without Life!’s express prior written consent, no portion of the Site or any Content may be duplicated, copied, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, Web site, or other medium for publication or distribution or for any commercial endeavour. Information on Life! products and services (such as data sheets, knowledge base articles, and comparable materials) that Life! has made available for downloading from the Site may be used by you, provided that (1) you do not remove any proprietary notice language in all copies of such documents, (2) you use the information only for your own personal, non-commercial informational needs, and (3) you do not copy, post, or broadcast the information in any other media.

Use of the Site

You may not access, acquire, copy, or monitor any portion of the Site or any Content through the use of any “deep link,” “page-scrape,” “robot,” “spider,” or other automatic device, program, algorithm, or methodology, or through the use of any similar or equivalent manual process, or in any way reproduce or get around the navigational structure or presentation of the Site or any Content, in order to obtain or attempt to obtain any materials, documents, or information through any means not intended for such purpose. The infrastructure of the Site, Lifesystems !’s or networks, or any other systems or networks connected to the Site or to Life! shall not be subjected to any action that creates an unreasonable or disproportionately significant load. You hereby undertake not to use any tool, program, or routine to disrupt or attempt to disrupt the correct operation of the Site, any transaction being carried out on the Site, or the use of the Site by any other person. Any message or transmission you send to Life! on or via the Site, or through any service made available on or through the Site, may not contain forged headers or other identifiers that might obscure the communication’s true source. You are not permitted to impersonate any other person or entity or to represent yourself as someone else. You are not allowed to use the Site or any Content for any illegal or unlawful purposes that are forbidden by these Terms of Use, or to encourage others to engage in illegal or unlawful behaviour that violates the rights of Life! or others.

Additional terms and conditions might be applicable to certain areas or features of the Site, such as contests, promotions, or other similar features, as well as to purchases of products or services. All of these terms are incorporated into these Terms of Use by this reference. By agreeing to these additional terms and conditions, you also represent that you are of legal age to use or engage in the relevant service or feature, as applicable. Even if Life! has been informed of the possibility of such damages, Life! will never be liable to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, unless such liability is expressly forbidden by law.

If Life! is determined to be liable to you for any harm or loss resulting from or connected in any way to your use of the Site or any Content, despite the other provisions of these Terms of Use, Life!’s liability !’s shall never exceed the greater of (1) the total of any subscription fees or similar fees paid with respect to any service or feature of or on the Site in the six months prior to the date of the initial claim made against Life! (but excluding The aforementioned limitation might not be applicable because some countries do not provide liability limitations.

Indemnity

Disregard for These Terms of Use

If Life! determines that you have violated these Terms of Use or other agreements or guidelines that may be related to your use of the Site, you agree that Life! may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site. You also acknowledge that any violation of these Terms of Use by you will be illegal, unfair, and will result in Life! suffering irreparable harm for which monetary compensation would be inadequate. Accordingly, you agree to cooperate with Life! in seeking any injunctive or equitable relief that Life! deems necessary or appropriate in such a situation. These remedies are in addition to any additional legal or equitable options available to Life!

You acknowledge and agree that Life! may terminate your access to the Site at any time, for any reason, including (but not limited to) (1) requests from law enforcement or other governmental entities, (2) requests from you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service provided on or through the Site, or (4) unexpected technical issues or problems.

Life! will be entitled to recover from you all reasonable lawyers’ fees and costs of such action, in addition to any other relief granted to Life!, if any legal action is taken against you as a result of your breach of these Terms of Use, and you agree to pay them. You acknowledge that if you violate these Terms of Use, Life! may terminate your access to the Site without notice and without liability to you or any other person.

Law that governs; dispute resolution

You acknowledge and agree that the laws of Singapore and South Africa, without respect to their conflict-of-laws rules, shall govern all things relating to your access to or use of the Site, including all disputes.

Any claim arising out of or related to these Terms of Use must be filed within one (1) year of the cause of action arising, or it will be forever barred. This restriction does not apply to claims made in accordance with the specific terms and conditions of purchase for goods and services. Other than for actual out-of-pocket costs, no recovery may be requested or collected; nonetheless, the victorious party shall be entitled to costs and attorneys’ fees. Should there be any conflict or disagreement between Life! and you over your use of the Site, the parties will make an immediate and sincere effort to settle it.

Either party may request mediation if we are unable to settle any such issue within a reasonable amount of time (not to exceed thirty (30) days). In the event that mediation is unsuccessful, the parties are free to pursue any legal rights or remedies that may be available to them.

Void 

Where Prohibited Life! is based in Singapore and manages and runs the m250.org site from there. Other Life! sites may be managed and run from different places outside Singapore.

Although the Site is accessible from anywhere in the world, not all features, products, or services mentioned, supplied, or offered through the Site are accessible to all users, available in all places, or suitable for use outside of Singapore. Life! has the right to impose restrictions on who can use any feature, product, or service, as well as how much can be provided in any given area. Any offer made on the site for any feature, item, or service is void where prohibited. You must take full responsibility for abiding by all local laws if you choose to visit the Site from a location outside of Singapore.

Miscellaneous

These Terms of Use represent the complete agreement between you and Life! with regard to your use of the Site. Life! will not accept any counter-offers to these Terms of Use, and any such offers are hereby expressly refused, unless otherwise specified in a purchase agreement you make into with Life!

Life’s failure !’s to insist upon or enforce strict adherence to these Terms of Use shall not be interpreted as a waiver by Life! of any provision or of its right to do so, nor shall any course of conduct between Life! and you or any other party be construed as modifying any provision of these Terms of Use. The purpose of these Terms of Use is not to grant any third parties any rights or remedies.

Life! allows access to Life! transnational information, hence it might include or cross-reference Life! products, initiatives, and services that have not been publicised in your nation. Such a mention does not suggest that Life! wants to announce such goods, initiatives, or services in your nation.
